The California Foreclosure Process
...every state follows a different procedure and set of laws during the foreclosure process. The two primary routes are judicial and non-judicial foreclosure and which process is followed can often be determined by which “theory” of ownership has been established in the state.
California is a lien theory state that uses a trust deed and underlying promissory note to secure the loans made against real estate. Essentially the promissory note is an unsecured “promise to pay” agreement between a borrower and lender; to provide security for the obligation borrowers sign a... (more)

2010-11 California Budget Proposal
In 2009, Governor Schwarzenegger along with other lawmaker’s went before the people of California with strategies to solve California’s financial problems such as the selling of state grounds and other not needed, but treasured landmarks. Adding up to the, “Robbing Peter to pay Paul”, syndrome.
This proposal was met with steep opposition, particularly from those living in Orange County, who were not willing to give up their beloved fairgrounds, and had moved to have the grounds rezoned making it worth half of what the governor had hoped to gain from the sale. (Hernandez) One of the state’s... (more)

No Fluoride for Babies Advises California Dental Association
The California Dental Association (CDA) joins a growing list of researchers, dental and health organizations advising against regularly mixing infant formula with fluoridated water to avoid discoloring babies' developing teeth (fluorosis). But little effort is made to inform the public, reports the New York State Coalition Opposed to Fluoridation, Inc. (NYSCOF). "Neither a nutrient nor required for healthy teeth, fluoride chemicals are added to many public water supplies and some bottled water in a failed attempt to reduce tooth decay," says attorney Paul Beeber, NYSCOF President.

The Sad State of Professional Sports in California
More and more people are tired of living in California. Folks don’t want to live in a broke state full of high prices, foreclosures and layoffs. And sports fans in the formerly Golden State are also a disgruntled bunch, because the teams we’re watching are mostly terrible.
I should say first that the L.A. Lakers, L.A. Kings, the San Diego Chargers, the Anaheim Ducks, the San Jose Sharks and the S.F. Giants probably don’t belong in this discussion…for now. The Lakers are the reigning NBA Champs and could repeat this year. The team has an incredible track record and the organization has... (more)

Leaving a Judicial Footprint: California Family Law
Most Americans are likely effected to some degree by family law, whether personally or through a friend, and probably unaware of the Elkin's Family Law Task Force. I recently addressed the Elkin's Family Law Task Force, a group appointed by the California Judicial Council to review family law proceedings and recommend proposals that will increase access to justice, ensure due process, and provide for more effective and consistent rules, policies, and procedures. Conducted in the formal Judicial Council Conference Room, it was intimidating. Nervous and limited to three minutes, my voice was... (more)

From the Top of the Hill to the Top of California Baseball
...the determination and the heart of a champion that would lead Ohlone to Fresno. It was a clutch bat by Zach Johnson and a warrior-like performance on the mound by Padilla that brought Ohlone to Fresno.
Then they traveled south to prove that they were, in fact, the best in the state of California. Ohlone forced the clock to strike 12 against the cinderella story that was El Camino. And the clock struck quick after six hitless innings for El Camino. Ohlone grounded a Rio Hondo team that tacked on runs against opponents like one tacks on Twitter updates.
But yet, they found... (more)

California back on the Gay Marriage Ban
" A federal appeals court put same-sex weddings in California on hold indefinitely Monday while it considers the constitutionality of the state's gay marriage ban.
The decision, issued by a three-judge panel of the 9th U.S. Circuit Court of Appeals, trumps a lower court judge's order that would have allowed county clerks to begin issuing marriage licenses to same-sex couples on Wednesday. "

Is Stimulus Package California's Life Saver?
... see values falling at a rate of 2%+ per month over the past 14 months. The message of the stimulus package is a good one but when we are faced with home values that are $200K below the loan amount on the home, there is only so much money to go around. This is probably not the remedy for California homeowners. Thus far, the stimulus package is focused on homeowners that are 5% underwater on their loan to value. The other piece of the package sounds great, but again, there is only so much cash to go around; the fed is putting the onus on banks to reduce homeowners' mortgages to a... (more)
The Big One: California's Future Earthquake Probabilities
Jonny Carson made a joke once when he said, “Things are looking up, the mud slides are putting out the forest fires.” For some folks living in California this hits a little too close to home. If over the last few months, the state hasn’t had its share of problems, with the financial crises. Now they have to worry about earthquakes.
Not that earthquakes are anything new to the natives, what makes this different is the timing. Says the (SCEC) Southern California Earthquake Center in cooperation with U.S Geological Survey, California Geological Survey, and the California earthquake Authority... (more)
